Types of tenancy fraud, why and how we tackle it, report it. Check your rights if you're a subtenant of a sublet social home.

If you commit tenancy fraud
If you make false statements to get a tenancy:
- your application may be cancelled
- your priority need may be reviewed
- if you got a tenancy we may serve notice and take court action to repossess the property
If you sublet your property we:
- will take action, including court action, to repossess the property
- may also apply to the court for an Unlawful Profit Order against a tenant who sublets, to pay us any profits they made from subletting
Tenancy fraud is a crime.
The following can be criminal offences under the Fraud Act 2006:
- making false statements
- failing to declare something you are legally required to declare
Subletting a council property is an offence under the Prevention of Social Housing Fraud Act 2013.
We will prosecute where:
- there is enough evidence
- it is in the public interest to do so
You could be fined, imprisoned or both, We may obtain an Unlawful Profit Order, or other financial order, against you.
