Leaseholder deed of certificate

Find out if you need to fill out a deed of certificate to get protection against costs for building and fire safety issues.

Who must fill out a certificate

The deed of certificate is for owners of leasehold home where Southwark Council is the freeholder.

Your lease, your building and any defect must all meet the qualifying criteria as set out in the law.

Your lease qualifies if:

  • it's more than 21 years long, on a single dwelling in a building of more than 5 storeys, or at least 11 metres tall 
  • you pay a service charge
  • your lease was granted before 14 February 2022
  • on 14 February 2022 the property was your only or main home, or you did not own more than 3 dwellings in the UK

You’ll need to complete a deed of certificate and we’ll confirm if we think you need one. 

We’re sending out letters called ‘notices’ to leaseholders in Southwark who we think may qualify. 

If you did not own the property on 14 February 2022 you must still fill in and sign the certificate.

We have a legal duty to ask and you have a legal responsibility to reply.

If you do not complete the deed of certificate, you may not benefit from the protections.

There are no known qualifying defects with Southwark council-owned buildings. But we must take precautions to comply with the law.
